Terms and Conditions of Trademark Real Estate's

FIRST ALERT Email Search Offer

The following terms and conditions (Terms) apply to this First Alert offer and must be accepted by the offeree (Offeree) to be eligible:

Offeror. This First Alert offer is made by Trademark Real Estate, LLC (Offeror).

Offeree. Eligible homeowners that order the First Alert by providing personal data and responses to the online order form found at TRDMRK.com/first_alert_order_form.htm are the offerees (Offerees).

Elligibility Requirements. This offer is only made to homeowners who have not yet contracted with a Realtor to be subject to an exlusive right to represent buyer agreement. The First Alert service is only offered to homeowners intending to purchase real estate in the central Ohio area (counties of Franklin, Fairfield, Delaware, Hocking, Knox, Logan, Madison, Marion, Morrow, Union, Licking, or Pickaway). Eligible Offerees must be 18 years or older and be able and legally competent to sell/purchase real estate.

This offer is subject to 1) the Offeree/home buyer reading and acknowleging that they have read the Trademark Real Estate's Consumer Guide to Agency Policy and 2) the offeree agreeing to allow Trademark Real Estate to act as the Offeree's exclusive buyer broker representive only on the properties that are identified via the First Alert emails and/or a client listing site (unless agreed otherwise). As such, and as is customary, Trademark Real Estate shall only be compensated by the property seller and or sellers' listing broker for the amount equal to three percent (3%) of the purchase price if the Offeree purchases any of the properties identified via the First Alert email program. The Offeree promises to provide to Offeror accurate and truthful responses to the online registration form and also to inform Trademark Real Estate if they no longer desire to continue the First Alert service, and to inform Trademark, when and if, the Offeree decides to engage another Realtor in a contractural business relationship. The offeree also promises to advise any home seller or Realtor that offeree is subject to this exclusive buyer broker representation agreement regarding any and all the prospective properties that are communicated to you by Trademark Real Estate.

Term of Offer. The terms of this First Alert offer and agreement shall correspond with the period of time that it takes offeree to buy their home; however, this time period shall not exceed twelve (12) months unless extended by mutual agreement. Either party may terminate this agreement by any form of written correspondence; however, Trademark Real Estate will continue to have protection for a period of 365 days, and be deemed by the Offeree, as the "procuring cause" on properties brought to the Offeree via First Alert.
